Licence Agreement, v4.97d.
By downloading and/or using this software you agree to be bound by the following
terms and conditions of the software licence.
1) The software PointOSale EPOS, the supplier Bordesley Electronics Ltd
(T/A 1-Stop EPOS, 208 Bordesley Green) and you as the user of the software.
2) The software is licenced to the computer system it is first installed for
the lifetime of that machine.
2/i) Installations without a hardware dongle, the software is locked to
the hardware identity of the computer and changes to the computer may alter
the hardware identity of the machine and invalidate the registration of the
software. Specifically, but not limited to, adding extra network adapters
(including connecting mobile phones and virtual network adapters), replacing
the hard disk drive, or re-installing/upgrading the operating system on
the EPOS system.
2/ii) Installations with an POS-Security dongle, the software is locked to
the security dongle and the hardware of the machine. Moving the dongle to
another computer may deactivate/invalidate the dongle, the original
installation of the software or any transferred installations, please contact
the support helpline. Software transfers with a hardware dongle will incur
a licence transfer fee of £100
3) The supplier may add, change or remove any features in new releases of the
software at any point without notice.
4) Any bundled, optional or extended support contracts for the software may be
limited to the current, or most recent releases of the software at the sole
discretion of the supplier, upgrades are provided free under this same licence
but are installed at your own risk.
5) Support contracts for the software are not transferable to third parties if the
machine and software are sold to any third party, software support contracts
are not transferable.
6) Software Support contracts do not include nor cover:
6/i) support for resetting lost passwords, re-enabling disabled user accounts,
nor restoring Admin accounts, these will incur a minimum fee of £50 and
require submission of proof of ID.
6/ii) setting up third party hardware ie. printers or other devices you have
purchased from other suppliers. Costs for setting up your own third party
hardware will incur a minimum fee of £25.
6/iii) data-recovery beyond assistance restoring backups. Catastrophic data
loss due to hardware failure, software failure, user error, mis-use or
abuse of the EPOS system are not part of the helpline support function.
7) Certain modules/features within the software require additional hardware
purchased from the supplier requiring an activation code to enable those
features, or may require a single one-off activation fee if you wish to use
those features with your own hardware (not purchased from the supplier - no
support can be given for such third party hardware).
8) There is no warranty for the program, to the extent permitted by applicable
law. Except when otherwise stated in writing the supplier and/or other parties
provide the program as is without warranty of any kind, either expressed or
implied, including, but not limited to, the implied warranties of
merchantability and fitness for a particular purpose. The entire risk as to
the quality and performance of the program is with you. Should the program
prove to be defective, you assume the cost of all necessary servicing, repair
9) In no event unless required by applicable law or agreed to in writing will the
supplier, be liable to you for damages, including any general, special,
incidental or consequential damages arising out of the use or inability to
use the program (including but not limited to loss of data or data being
rendered inaccurate or losses sustained by you or third parties or a failure
of the program to operate with any other programs), even if such holder or
other party has been advised of the possibility of such damages.
10) If the EPOS terminal/machine and/or software are sold onto any third party these conditions
remain binding on the new users and owners.
